Ok homeowners in trouble, the things you really need to know are:
1- It is possible to fight your bank, if you have the right information.
2- The right information is not easy to find, given all the sharks out there trying to take your money when they don't know what steps to take either. They just want your money.
3- I can give you the right information - I have a law degree,so I can read legal documents easily, and know how to assess a situation to tell you whether you are able to fight foreclosure, given your circumstances. I've been helping homeowners to successfully fight foreclosure for several years, and we've had very good results. (The homeowners and myself -we're a team)
The questions you should answer in order to determine if you can fight the foreclosure are:
a- Did you either buy or refinance your property after 2005?
b- Was your mortgage securitized?( If your property documents show a "Trustee" for a trust, then answer is "yes")
c- Do the documents in the chain of title for your property show any irregularites?
d- Have you applied for a loan modification?
e- Has your mortgage been sold to a different bank since you obtained it?
The most important part of an assesment of your situation is to examine the property documents that have been filed with your county recorder of deeds. If you don't have those documents, you can get them by visiting your county recorder's office. (A lot of states have them online now)
I would be glad to review them WITHOUT CHARGE to let you know if there are any irregularities in the record. It's those "irregularities" that, if found, give you the grounds to challenge your bank's right to foreclose. That includes a gap in the chain of title, forged signatures on the documents, assignments to nonexistent entities, etc. etc. They've all appeared lately, and the banks are doing it thmeselves, deliberately. They hope no one checks the record and calls them on it. Then, of course, they get away with it.
